Draeger Safety Canada Limited and our affiliate companies (“Draeger,” “we,” “us” or “our”) recognize the importance of protecting the privacy of our online visitors. The following privacy policy (“Privacy Policy”) describes how we collect, use and disclose the information obtained about you from your visits to our website available at www.safetyshop.draeger.com/en_ca (the “Site”). This Privacy Policy does not apply to information that we collect without technological means, such as over the telephone or in person.


PLEASE REVIEW THIS PRIVACY POLICY CAREFULLY. When you submit information to or through the Site and by using the Site, you consent to our collection, use, disclosure and retention of your information as described in this Privacy Policy.

1.       Personal Information Collected

Draeger collects personally identifiable information from you, which may include your name, company, address, e-mail address, telephone number, username and password for your account and any other identifying information you may provide to us, including when you contact us through the Site. This information is collected and stored electronically when you create an account with us, place an order through the Site, or complete any online form available on the Site. You are not required to provide us with such information, but certain features of the Site may not be accessible or available, absent the provision of the requested information.

We will collect, use, and disclose your personal information when we have your consent, which may be express or implied depending on the circumstances, or as otherwise required or permitted by applicable law. You have the right to withdraw your consent at any time, subject to applicable law and contractual restrictions. Should you withdraw your consent, we may not be able to provide all available services to you.


2.     Personal Information Collected Automatically

Information about you and your computer hardware and software may automatically be collected by Draeger when you use the Site. This information may include: your IP address, browser type, language and version, operating system and its interface, domain names, access times, pages visited, page from which the request comes and other technical information such as protocol status and substatus, bytes sent and received, and server information. We may also collect information about how you interact with the Site. Other than personal information associated with your IP address, this information is de-identified, and no personal web browsing profiles or similar personal profiles are created or processed. We use this information solely for our internal business purposes, including for the operation and improvement of the Site, for technical troubleshooting, to maintain quality of the Site and to provide general statistics regarding use of the Site.


3.     Cookies and Other Information Collection Tools

What are cookies? A cookie is a small file containing a string of characters that is sent to your computer when you visit a website or use an online service. When you visit the website or use the service again, the cookie allows that website or online service to recognize your browser or device. Cookies may store unique identifiers, user preferences and other information.

Duration of Cookies. We may use “session cookies” or “persistent cookies.” Session cookies are temporary and expire once you close your browser or once your session ends. Why do we use them? 4.     How Personal Information is Used

We may use the personal information we collect for any of the following purposes:

·         to carry out our obligations arising in respect of any contracts entered into between you and us (including, without limitation, the Sales Channel Partner Agreement);

·         to facilitate your use of our Site and your account, and to send you important information regarding our relationship with you or regarding the Site, such as information about changes to our terms, conditions, policies, and other administrative information; and

·         as otherwise described at the point of collection.


5.     Sharing of Information

We may share your personal information only as described in this Policy or as otherwise described to you at the point of collection. In addition to the disclosures described throughout this Privacy Policy, and subject to applicable law, we may disclose your personal information in the following situations:

·         Companies within our group. We may share your personal information with our subsidiaries, affiliates, and operating groups for any one of the purposes listed in Section 4 or with whom we share services, infrastructure, systems and technology.

·         Third Party Service Providers Performing Services on Our Behalf. We may share your personal information with our service providers, suppliers, and our legal and financial representatives to perform the functions for which we engage them. For example, we may use third parties to host the Site or assist us in providing functionality on the Site, provide data analysis on the Site, or to send out email updates about the Site. All such third parties are made aware of the confidential nature of your personal information. Your personal information will be shared with such third parties on a “need to know” basis only and we limit the information shared to what is needed for the specific task being performed or fulfilled. We will disclose personal information as we deem necessary to respond to a subpoena, regulation, binding order of a data protection agency, legal process, governmental request or other legal or regulatory process. We may also share personal information as required to pursue available remedies or limit damages we may sustain. 

·         Changes of Control. In the event of sale, transfer, merger, reorganization, dissolution, or similar event we may transfer your information to one or more third parties as part of that transaction, including during the negotiation of an actual or contemplated transaction, but we only provide as much information as is needed for the purposes of the transaction. If we sell our organization or merge with another party, you hereby consent to the transfer of your personal information and all information you provide to us, to our successor for the same purposes as set out in this Privacy Policy.

Draeger does not share your personal information with third parties for those third parties’ direct marketing purposes.

Only authorized personnel, who have a business need to know, have access to your personal information, for example: our customer service centre, billing department and personnel responsible for providing products and services to our customers. These employees have been informed by us of their obligations to preserve the confidentiality of your personal information. We apply reasonable technical, contractual, administrative and tangible measures to protect your personal information against its unauthorized use or disclosure as well as its loss or theft, including encryption when required. Our employees who have access to your personal information may use it only in accordance with the principles set out herein and applicable legislation.


6.     Your Choices 

You may update your account information or delete your account by going to your account settings.

You may opt out of having your personal information used or disclosed for a specific purpose at any time by contacting the Privacy Officer as set out below. Should you withdraw your consent, we may not be able to provide all available services to you.


7.      Links to External Websites

Our Site may contain links to third-party websites. Any access to and use of such third-party websites is not governed by this Privacy Policy but is instead governed by the privacy policies of those third-party websites, and we are not responsible for the information practices of such third-party websites.


8.     Security Used & Retention of Personal Information

Draeger uses reasonable security measures designed to prevent unauthorized intrusion to the Site and the alteration, acquisition or misuse of personal information. Unfortunately, the transmission of information via the internet is not completely secure and we cannot guarantee the security of your data transmitted to our Site; any transmission is at your own risk. Subject to any mandatory legal obligations to which we may be subject, we will not be responsible for loss, corruption or unauthorized acquisition or misuse of personal information that you provide through the Site that is stored by us, or for any damages resulting from such loss, corruption or unauthorized acquisition or misuse. It is your responsibility to protect the security of your login information.

We will retain your personal information for as long as necessary to fulfill the purpose for which it was collected, or as required by applicable laws or regulation. Personal information that is no longer required is destroyed, erased or anonymized. Your consent to our collection, use and disclosure of your personal information for such purposes remains valid after the termination of the Company’ relationship with you.


9.     Cross-Border data transfers 

Please note that your personal information may be accessed, transferred, disclosed, stored and processed in Canada and in any other country where Draeger, its affiliates, its third party service providers, and its agents are located or where their cloud computing infrastructures may be hosted.

In order to provide you with our services, we may transfer your personal information to, or store or access it in, foreign jurisdictions.  Where your personal information is transferred to another jurisdiction, we will take reasonable steps to ensure that the personal information will not be used for purposes that are not relevant to the purpose for which it was collected or communicated to third persons without your consent. Where applicable and required by law, we will request your consent to this transfer and we will take steps to ensure that your personal information receives an adequate level of protection in the jurisdictions in which we process it and complies with applicable local data privacy and protection laws. 


10.  Do Not Track

Our Site does not currently take any action when it receives a Do Not Track request. Do Not Track is a privacy preference that you can set in your web browser to indicate that you do not want certain information about your webpage visits collected across websites when you have not interacted with that service on the page. 11.    Children

We do not knowingly collect or maintain personal information from any person under the age of fourteen. No parts of our Site are directed to or designed to attract anyone under the age of fourteen.


12.  Access and Complaints

We make commercially reasonable efforts to keep your personal information complete, up-to-date and accurate. Should you wish to exercise your rights to access, update, correct or delete your personal information, or express any concerns regarding our use of your personal information, please contact our Privacy Officer. We ask that you provide us with the name, address and email address that you previously provided to us, a brief description of under what circumstances you provided your personal information to us, and the purpose of your request. If you are unsure as to whether we are holding any personal information that belongs to you, you may also contact our Privacy Officer for confirmation.

We will make reasonable efforts to respond to your request as soon as practicable, or in any event, in compliance with applicable laws. In order to protect your privacy and security, we will take steps to verify your identity before granting access or making any changes to the personal information that we maintain.

Requests and complaints may be directed to our Privacy Officer. We will use our reasonable efforts to respond to your request in a timely manner and will respond to your request within the time period permitted by applicable laws and regulations. Quebec Residents

If you are located in the province of Quebec, we must reply to your request for access or rectification, or to any complaint regarding the protection of your personal information, promptly and no later than thirty (30) days after your request is received.

If you are located in the province of Quebec, you have certain additional rights under applicable data protection laws. These may include the rights (i) to restrict dissemination of your personal information or to have your personal information de-indexed from search results; (ii) to be informed when your personal information was used to render a decision based exclusively on automated processing and to request further information about the automated decision-making; (iii) to data portability and (iv) to the erasure of your personal information.
